Just noticed this in my VPS' ToS: "We do not tolerate the following activities on our servers: [...] IRC activity (client, server, bot, etc.); [...]" I can understand every other item (no hacking, no DoS, no public proxies, etc) but I cannot understand this one. Why would a VPS provider want to avoid having an IRC service on one of the servers?
Exoscale for sure allows it if you're looking for an irc friendly service. We use irc extensively for ops/communication.

Do people still use IRC for warez? That would be an overreaction seeing as you could use almost anything for distributing warez.
how about the idea that there was at least some time in the past when irc servers used to get ddos-ed a lot? i don't know how things are these days...

IMO the comment saying that "it's likely that they didn't take the time to come up with their own AUP or TOS and just copied it" makes the most sense.

i do not see any new episodes here: http://blog.cognitect.com/cognicast/ and i also remember there being some statement recently to the effect that there might be new epsiodes before long
